4. Description of Service

Phone Her Now is an entertainment platform that connects callers with independent operators for phone calls, web chat, and video chat services. Operators are independent contractors and not employees of Phone Her Now. We act as a technology service that facilitates connections between users and operators.

The Site includes phone services, web chat, video chat, messaging, digital content, operator listings, and related features. We reserve the right to modify or discontinue any aspect of the Site at any time with or without notice.

5. Operator Account

To become an operator, you must complete the registration process, provide accurate information, and agree to these Terms of Service. You must be at least 18 years of age. All information you provide must be correct, current, and complete. We reserve the right to refuse or terminate any account at our sole discretion.

Your operator account is for your sole personal use. You are solely responsible for all activity under your account. You agree to maintain the confidentiality of your password and to notify us immediately of any unauthorized use. You may not share, assign, or transfer your account to any third party.

Phone Her Now does not conduct criminal background checks on operators but reserves the right to conduct any background check or screening at any time. You represent that you are not required to register as a sex offender with any government entity.

6. Prohibited Content and Conduct

You shall not use the Site or our services in any manner which is illegal under applicable law. Without limitation, the following are strictly prohibited:

Child pornography or any depiction of a minor. Images of children are not permitted under any circumstance.

Content involving bestiality or animals in any sexual context.

Content promoting or depicting necrophilia.

Escort services, in-person meetings, or exchange of personal contact information between operators and callers.

Spam, harassment, defamation, or excessive contact with any user or operator. Phone Her Now reserves the right to determine, in its sole discretion, whether content violates these terms and to remove such content without notice.

7. AI Prohibition

You will not use any form of artificial intelligence to create derivative works from any material appearing on the Site or received through our services. This includes without limitation making or using any form of recording, visual depiction, deepfake, or AI-generated content using any operator name, image, voice, or likeness. AI scraping is strictly prohibited. Violators will be immediately terminated and may be subject to civil and criminal prosecution.

8. Intellectual Property

Phone Her Now shall own all rights, titles, and interests in the Site and, to the extent described in our Operator Rules, in operator services and content. No copyrights, patent rights, trademarks, or other licenses are conferred, either expressly or by implication. Member usernames may be recycled if you are not actively using them or your account has been terminated.

You are not allowed to take audio recordings, screenshots, screen recordings, or reproductions of the Site, operator services, or content. Doing so constitutes a material breach and may result in termination and civil or criminal prosecution.

9. Limitation of Liability

You understand and agree that you are solely responsible for your use of the Site and services. Phone Her Now assumes no responsibility for policing its users or operators. We do not verify, guarantee, or make any representations regarding the identity or qualifications of any user or operator.

If you have a dispute with any user or operator, or suffer any harm arising out of or connected with any services, you hereby waive all claims against and release Phone Her Now from any and all liability for claims, demands, damages, costs, and expenses of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed.

10. Indemnification

You agree to indemnify and hold harmless Phone Her Now, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including attorney's fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws applicable in your jurisdiction. You consent to the exclusive jurisdiction and venue of courts for any dispute arising out of or related to these Terms or your use of the Site.
