Terms of Service

These Terms of Service (“Terms”) form a legal agreement between you (“you” or “User”) and PhoneHerNow.com (“PhoneHerNow,” “we,” “us,” or “our”). By creating an account, accessing the site, adding funds, or placing a call, you agree to be bound by these Terms. If you do not accept these Terms, you must exit the site immediately and may not use our services.
1. Eligibility & Age Requirements
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to register or use PhoneHerNow. All performers featured are 18 years or older. If you are underage, you must leave immediately. By using the site, you affirm you have the legal right to access adult services in your jurisdiction.
2. Mandatory Accounts
An active account is required to use PhoneHerNow. No anonymous or guest access is permitted. Registration requires accurate information and acceptance of these Terms. By registering, you consent to receive service-related emails, notifications, and promotional messages. If you do not consent, you cannot hold an account.
3. Payments, Billing & Refunds
Users may add funds to their account or pay directly by phone after logging in. All transactions are processed securely. Payments are final and non-refundable except as required by law. Attempting to pay performers outside the platform is strictly prohibited and will result in permanent account termination without refund.
You are responsible for all activity and charges under your account. Billing errors must be reported within 7 business days to support@phonehernow.com. We will investigate and, at our discretion, may issue credits to your account.
4. Privacy & Anonymity
PhoneHerNow protects your anonymity. Performers never see your billing information. However, if you voluntarily disclose personal information (name, phone, email, social media, address), you do so at your own risk. Sharing personal contact information is strictly forbidden and will result in permanent account closure without refund.
5. Prohibited Conduct
- • Do not harass, abuse, threaten, or defame performers or staff.
- • Do not share personal information with performers.
- • Do not attempt to pay or contact performers offsite.
- • Do not request or engage in illegal activity.
- • Do not record, copy, or distribute calls or content without express written consent.
- • Do not create fake accounts or impersonate others.
6. Platform Role
PhoneHerNow is a technology service connecting members with independent performers. We do not create, produce, or control the content of calls or interactions. Each performer is solely responsible for their compliance with applicable laws. The site is for private entertainment purposes only.
7. Intellectual Property
All site content, design, logos, and trademarks are the exclusive property of PhoneHerNow and may not be used without permission. You may not copy, distribute, or exploit site materials or services for commercial purposes.
8. Account Suspension & Termination
We reserve the right to suspend or terminate accounts for violations of these Terms or applicable laws, at our sole discretion, without refund. Accounts may also be suspended for fraudulent activity, chargebacks, or misuse of the platform.
9. Disclaimers & Limitation of Liability
The Site and services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, or accuracy of information. To the fullest extent permitted by law, liability is limited to the greater of one hundred dollars ($100) or the amount paid by you in the twelve (12) months prior to the claim.
10. Dispute Resolution
Any dispute arising under these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). You waive the right to a jury trial or class action. Arbitration will take place in Texas unless otherwise required by law.
11. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict of laws principles.
